The constitution of New Mexico established the governmental structure of New Mexico. The Government [1]of New Mexico is composed of the Executive Branch, The Legislative Branch and the Judicial Branch. The executive branch comprises of the Governor and several other statewide elected officials who includes the Lieutenant Governor, State Treasurer, Attorney General,  State Auditor, Secretary of State and Commissioner of Public Lands, as well as the Governor's cabinet. The Legislative Branch of New Mexico is composed of the House of Representatives and Senate. The Judicial branch of the government consists of the New Mexico Supreme Court and lower courts. New Mexico also has a local Government that comprises of the counties, municipalities and special districts.

The Executive Branch of New Mexico

The Governor[2] is the head of the Executive Branch of the Government of New Mexico. She is the first female governor of New Mexico and also the first Hispanic female Governor in United States history. The top priorities of the Governor includes balancing the budget, educating the children, ensuring transparency and ethics in government and also to keep the people of New Mexico safe.

The Lieutenant Governor is the second highest elected official in New Mexico.The Lt. Governor serves as the President of the New Mexico Senate and also as an acting Governor when the Governor is absent. The Lt. Governor also provides constituent services and serves as a member of several boards, councils, and commissions.

The Legislative Branch of New Mexico

The State Legislature or the General Assembly [3] of New Mexico summons in regular sessions on the third Tuesday in January every year. The Legislature meets in odd-numbered years for 60 days and in even-numbered years the legislature meets for 30 days. The Legislature is composed of House of Representative and the Senate. The members of the Legislature are not paid for their legislative work but they do get a daily living allowance for each day of official legislative work. The Legislators are chosen from districts of approximately equal population. A single district is formed by combining several counties with small populations.

The Presiding Officer of the House of Representative is the Speaker. The Speaker is responsible to appoint the members to the House standing committees and also to maintain order in the house. The New Mexico Legislature comprises of a 70-member House of Representatives. Presently there are 37 Republicans and 33 Democrats in the House of Representatives.

The New Mexico Senate consists of 42 members out of which 25 are Democrats and 17 are Republicans. The Lieutenant Governor is the President of the Senate. The President presides over the daily sessions.

The Judicial Branch of New Mexico

The New Mexico Judiciary [4] branch applies regulations and law and also ensures justice in the state. The Judicial power of the state of New Mexico is in the Supreme Court, a Court of Appeals, Districts courts and other such courts set up by the General Assembly.

The Supreme Court of New Mexico is the highest court and final court of review of the state. The Supreme Court of New Mexico is also the head of the Judicial Branch of Government. Apart from reviewing the decisions of the lower courts, the Supreme Court also has supervisory authority and general administrative over all State courts and attorney regulations.

The Court of Appeals of New Mexico is the intermediate appellate court. It is the second highest court after the Supreme Court. The entire state comes under its jurisdiction. Presently, the Court of Appeals reviews appeals in all cases, except the cases that involve death sentences or life imprisonment and cases involving habeas corpus.

District Courts of New Mexico are courts of general jurisdiction which hold jury trials. Presently there are 13 different districts. The District courts are presided over by Ninety-four judges. This court hears cases that include real property rights, Tort, estate, contract, mental health, Exclusive domestic relations, and appeals for administrative agencies and lower courts, Misdemeanor, miscellaneous civil jurisdiction Exclusive juvenile jurisdiction and Exclusive criminal appeals jurisdiction.

Magistrate Courts are courts of limited jurisdiction. New Mexico has 54 magistrate courts that are presided over by Sixty-seven judges. The magistrate courts look after the cases that include Felony preliminary hearings, contract, Tort, Felony preliminary hearings, Misdemeanor and other traffic violations.
Some other lower courts in New Mexico include Bernalillo County Metropolitan Court, Municipal Court and Probate Court.
